The Kingdom of Morocco and the Socialist People’s Libyan Arab Jamahiriyah, out of their realization of the dangers (words indistinct) as a result of the policy of violence and aggression which the Zionists have been practicing, flouting the sanctities of Islam and violating the rights of the Musulims and Arabs, after (worlds indistinct) and have been blinded by arrogance, and so they no longer paid any attention to the principles and high ideals on which the international society is founded nor to the resolutions adopted by the international organizations and conferences of whatever level, and out of their feeling that these dangers threatening the Arab nation and the Islamic world headed by Palestine and Jerusalem must be checked through the unification of views and wills and that efforts must be pooled to check aggression, establish rights, and safeguard the interests of the Arabs and the Muslims and defend their right to existence and dignity.
And, out of their belief that the adoption of this course will be a decisive factor giving the Arab nation and the Islamic world the opportunity to regain their past glory and win the appropriate position compatible with their glorious past;
And (words indistinct) to lift their peoples and prepare them to enter the 21st century armed with all the things that will enable them to occupy a prominent position among the peoples who are advanced in the fields to science and technology and all other fields of human and civilization;
And in consideration of the obstacles standing in the way of Arab unity as revealed by past experience, and in consideration also that wisdom dictates that lessons be learned from setbacks which were actually the result of disregard of the obstacles in the way, and that wisdom demands persistent and continued word for the achievement of the desired goal gradually and without haste or improvisation (word indistinct) implementation;
And out of their feeling in particular of the strong bonds that bind the peoples of the Arab Maghreb together – bonds based on their common geography, history, religion, language, methods of knowledge, and culture;
And in consideration of the long-held aspiration of these peoples and their leaders, to establish unity among them to bolster the bonds among themselves which are based on the unity of destiny and dialogue and which lead them toward a complementary unity of considerable weight, politically and economically, among the advanced peoples of the world, particularly in the fold of the Mediterranean basin countries, who irrespective of their individual characteristics have a cultural heritage that derives its essence from spiritual and (word indistinct) common values;
And out of their wish to respond to these aspirations and to contribute toward the realization of these aspirations in a manner characterized by realism that would move them from the sphere of dreams to the sphere of precise implementation;
And out of their realization that the best way to achieve this lies in the creation of federation that would act as a springboard for the establishment of wider structures aimed at serving the unity of the Arab peoples and Islamic peoples and realizing the dignity and strength to which they aspire;
And in view that this federation constitutes a cornerstone of the unity to the Arab Maghreb and, subsequently, a historic step to achieve the unity of the Arab nation, have agreed on the following;
Article 1: In accordance with this pact, a federation that will include the Kingdom of Morocco and the Socialist People’s Libyan Arab Jamahiriyah will be founded and will be named the Arab-African Federation.
Article 2: The presidency in the (?administrative) body of the federation. His majesty the king of Morocco and his excellency the leader of the 1 September Revolution will assume the presidency jointly, and (word indistinct) of issuing decisions.
Article 3 : A general secretariat will be created (words indistinct) the presidency, the headquarters of which will alternate between the two countries and will have a permanent representation in each. The federation’s secretary general must be a citizen of the country where the headquarters of the general secretariat in (?located), and the assistant secretary general must belong to the other country. The period of succession will be 2 years.
Article 4 : The federation will have the following councils:
- Political Council, b) Defense Concil, c) Economic Council, d) Educational and Intellectual Work Conncil.
These councils will be composed, in accordance to the presidency decision, by delegates from each of the two countries. The number of representatives from each country will be the same and will carry out a consultative role. Their tasks within their specialist fields will be to study the issues referred to them by the presidency, propose solutions and prepare plans that the presidency asks them to prepare whenever it deems so.
Article 5 : The federation will have a federal body which will be composed of members of the House of Representatives of the Moroccan Kingdom and members of the General People’s Congress of the Socialist People’s Libyan Arab Jamahiriyah. The task of this body will be to put forward to the presidency proposals to strengthen the federation and realize its objectives.
Article 6: The federation will have an executive committee composed of the Council of Ministers of the Moroccan Kingdom and the General People’s Committee of the Socialist People’s Libyan Arab Jamahiriyah. Its task will be to execute and follow up the presidency’s decisions. The executive committee will hold alternate regular meetings in each contry.
Article 7: The federation will have a federal court. (words indistinct) a decision form the presidency. In the event of a dispute between the two sides regarding the implementation or realization of this pact, they will have the right to submit their complaint to the court for (word indistinct). The rulings and opinions of the court are final and binding.
Article 8 : The federation aims at strengthening ties of fraternity between the two countries and their peoples, working for the advancement of the Arab nation and the defense of its rights, contributing to the maintenance of peace whenever it is based on the principle of justice and harmony and characterized by continuity and stability (word indistinct) joint policy in all spheres, contributing to uniting the Arab Maghreb and, subsequently, to achieving the unit of the Arab nation.
Article 9: The joint policy referred to in the previous article aims to achieve the following objectives :
- In the international field – to strengthen ties of fraternal friendship between the two countries and establish firm diplomatic cooperation between them.
- In the defense field – to maintain the independence of both countries.
- In the economic field – to work toward achieving technical, industrial, agricultural, commercial and social development in both countries, and to take all necessary means to reach this objectives, especially by creating joint institutions and preparing (word indistinct) programs.
- In the educational field – to establish a kind of cooperation aimed at developing (?education) at various levels, maintaining the spiritual and moral values inherent in Islamic teachings, and preserving Arab national identity, to adopt necessary measures to reach all these objectives, especially by exchanging lecturers and students and creating joint institutions of university education, training, and research.
Article 10 : The federation will have and administrative and a development budget.
Article 11: Each country will accord absolute respect to the sovereignty of the other country and will undertake to not interfere in the other’s internal affairs.
Article 12: Any aggression aimed at one of the countries will be considered an aggression against the other country.
Article 13: The federation will not prevent either of the participating countries from signing agreements that are (?the same) or similar to the pact on which it is based; on the contrary, each country is permitted to sign agreements with other countries.
Other countries belonging to the Arab nation or the African community are permitted to join this pact and become members of the federation providing that the two sides consent to this.
Article 14: A special committee whose members will be appointed by the presidency will be responsible for presenting the regional draft agreements aimed at explaining the aforementioned clauses. The aforementioned proposal will be submitted to the presidency for examination.
Article 15: This pact will come into force as soon as it is approved by the people of the kingdom of Morocco and the people of Socialist People’s Libyan Arab Kamahiriyah though a referendum that will be in accordance to the measures in operation in each of the tow countries.
